Attorney Nathan Bax was featured in the SC Lawyers Weekly Newspaper for his recent health insurance victory.  This case involves the wrongful denial of medically necessary treatment for a rare neurological condition, Guillian-Barre Syndrome (hereinafter “GBS”).  The health insurance company, BlueCross BlueShield of Illinois, denied Mr. Bax’s client’s health insurance benefits, claiming that her medically prescribed intravenous globulin therapy (hereinafter “IVG”) was not medically necessary under the terms of the plan.  Mr. Bax successfully argued that BCBS of Illinois abused its discretionary authority in denying these benefits.  The Court found that BCBS of Illinois misapplied the terms of the plan and that the treatment was medically necessary.  The full article is found below.
